Rental Conditions

Definitions:

  1. Tenant: the customer who rents a holiday home.
  2. Landlord: the owner (or his representative) of the rented holiday home

1.Booking and payment

1. If you book directly with the landlord:

  1. You can request to book by telephone, message, email, social media or through our website.
  2. The tenant will receive an email or message stating the rental amount and costs for the requested booking period.
  3. The tenant will also be requested to transfer a deposit of 300 euros by bank transfer.
  4. The booking is confirmed after the landlord receives the deposit on his bankaccount.
  5. The  rental amount or half of the amount and costs must be transferred to the landlord no later than 30 days before the arrival date of the tenant, by transferring this amount the tenant agrees to the rental conditions. The 2nd half of the rental amount needs to be transferred no later then 14 days before arrival of the tenant. 
  6. The deposit will be fully refunded to the tenant 1 to 2 weeks after the departure of the tenant if everything has been left in a good condition and no damage has occured.

2.If you book through a bookingswebsite (booking.com, nature.house, airbnb,..

  1. The tenant books the desired vacationperiod via the booking website, the rental amount is also transferred to the booking website.
  2. The tenant will receive an email or message with information about the holiday home and the request to transfer a deposit of 300 euros.
  3. The tenant must transfer a deposit of 300 euros to the account of the landlord no later than 30 days before arrival. By transferring this amount the tenant agrees to the rental conditions. 
  4. The deposit will be fully refunded to the tenant 1 to 2 weeks after departure if everything has been left in a good condition and no damage has been

2.Deposit

  1. The deposit serves to cover the expenses in case of any accidents or damage that occurs during your stay.
  2. Complaints regarding the inventory or any existing damage will be accepted up to 12 hours after your arrival. This must be reported to the landlord or his representative within this time frame.
  3. The main tenant is liable for any damage caused by him / herself, co-tenants, any visitors or pets, this is also applicable after the departure of the tenant. 
  4. The holiday home will be thoroughly checked for any damage during the time that it is being cleaned after the tenants departure. If the holiday home is left behind in a state that would require extra work then usual, extra cleaning hours will be charged. Reminder: the house must be left clean and tidy, waste/garbage must be separated in the garbage bins outside. See “End of your stay – cleaning”
  5. If everything is found in a good state and no damage or breakage has been found, you will receive your deposit back by banktransfer. In case the deposit can not cover the cost of the damage, the tenant is obliged to make an additional payment. Likely through the tenant’s family insurance or liability insurance.
  6. To prevent any disagreements or misunderstandings it is advisable to keep any broken items asside, so the landlord or his assistant are aware of what is broken and can replace it.
  7. In case of any accident, It is advisable to inform the landlord or his assistant so an amicable solution can be met with the consent of both parties, i.e. the landlord as wel as the tenant
  8. breaking a drinking glass or cup can happen, this will not be charged, however please inform the landlord or his assistant of the item that broke.

3.Cancellation

  1. In case the tenant is not able to occupy the rental property for the agreed period, for whatever reason, he or she must immediately inform the landlord of this fact.

  3. In case the tenant cancels the rental agreement prior to 30 days before the start of the rental period, no rental amount will be charged. In case the cancellation takes place between 30 to 14 days before the start of the rental period, the amount payable is 40%, however in case the cancellation takes place within 2 weeks of the start of the rental period, the full rental amount will be duly charged.

4.Obligations and rights of the tenant

  1. It is required that the tenant, co-tenants, or visitors treat the holiday home with needed care, taking into account the tranquility of the surrounding area.
  2. The houserules provided at the holiday home are an integral part of the rental agreement and must be strictly observed.
  3. It is always our intention to offer you a clean, well-maintained and well-kept home.
  4. If upon arrival this would not be the case, or in case anything is lacking or in case of any defects, it is advisable to contact the landlord or his representative so that he can come and determine the problem.
  5. The holiday home is a non-smoking area and it is therefore not permitted to smoke inside the house.
  6. It is strictly forbidden to use the house and garden to organize parties and/or drinking parties.
  7. It is not permitted to burn wood in the barbecue and to make a fire in the garden.
  8. Furniture such as beds, sofas, cupboards, etc. should not be moved or shifted, as this can cause damage to the walls and furniture.
  9. The tenant must ensure that he does not cause any noise or inconvenience to the neighbors. In Belgiumthe law prohibits noise after 10 p.m. Please respect this law and the peace of the neighbors.

5. Obligations and rights of the landlord

  1. The landlord is obliged to ensure the rented property is available to the tenant on the agreed date and time in good condition.
  2. Facilities:
  1. Due to unforeseen circumstances, it may occur that certain facilities may fail to function properly or are temporarily not available.
  2. Some facilities are seasonal and are not available all year round.
    1. The landlord cannot be held accountable for:
  • Loss, theft, damage or any kind of injury to the tenant and / or his fellow guests during his stay in the holiday home.
  • For damage caused by natural disasters, nuclear disasters, attacks, strikes, acts of violence, pandemics, etc.

6. Non-performance by landlord

  1. In case the landlord does not fulfill his obligations, the tenant will be entitled to demand compliance or compensation.
  2. If the non-compliance warrants it, the tenant will be permitted to end the rental agreement without a re-course to court action.
  3. In case the tenant wishes to exercise this right, he/she must inform the landlord immediately in writing, citing the reasons. The landlord will in that case refund all or part of the rental amount, depending on the type and period of time of the non-compliance.
  4. The tenant retains the right to claim compensation. With regard to this matter, it is noted that the landlord cannot be held responsible for any disruption, alteration or hindrance to the stay of the tenant if this is the result of unexpected or unavoidable matters outside his control.
  5. The landlord cannot be held responsible for inconvenience as a result of work by third parties such as the council, local government, garden services, etc. The landlord does not accept responsibility for loss or theft of or damage to luggage, personal items or vehicles, nor for any costs resulting from late arrival at the holiday property due to delays.

7. NON-FULFILMENT OF TENANT

  1. If the tenant has not paid the rental amount on the due date or does not comply with other requirements regarding this rental agreement, the landlord has the right to demand compliance and/or compensation. In case the non-compliance warrants it, the landlord has the right to end the rental agreement without re-course to court action.
  2. In-case the landlord wishes to exercise this right, he must inform the tenant immediately in writing, citing the reasons.
  3. The landlord retains the right to claim compensation.

8. Pets

  1. A maximum of 2 pets are allowed in the rented property, after agreement and consent of the landlord.
  2. Guests are not allowed to leave the pets unattended or alone in the holiday home, except if it can be kept in a cage.
  3. The tenant needs to bring the pet’s own sleeping and food equipment.
  4. The Pets are not allowed to make use of the beds, seats, shower or jacuzzi of the holiday home.
  5. The animals are not allowed in the bedrooms or on the first floor, they are only permitted on the the ground floor and garden.
  6. Please dry a dog after a walk before entering the home.
  7. Please do not let your dog jump against the windows or walls to avoid scratches on the glass or walls.
  8. At the end of the stay, it is expected that all dog hairs are removed by the tenant.
  9. Guests need to make sure the garden is dog poo-free upon departure.
  10. These points are included for hygienic reasons and to prevent damage to the holiday home.,
  11. In case pets cause damage to the home or garden, the cost to cover the damage will be deducted from the deposit.

9. Age and amount of persons

  1. The property will not be given in rent if no adult is part of the group of persons staying in the holiday home during the entire rental period.
  2. The property is to be rented by maximum 5 persons. If the group of persons exceeds 5 persons, the landlord must be informed in advance. Failure to do so may result in immediate termination of the stay without a claim for reimbursement.

10. Time of arrival and departure

It’s important for the guest to respect the arrival and departure timings. It is always our aim to let you stay in a clean and neat house, so sufficient time is required between departure and arrival timings of guests.

  1. Arrival time/ check in: the holiday home is available from 4:00 PM (16:00) onwards on the day of arrival.
  2. Departure time/ check- out:
  • Weekdays: until 10:30 AM
  • Sunday 6:00 PM. (18:00)

11. Bedsheets, towels, kitchen napkins

  1. Bedsheets, pillow covers, towels and kitchen napkins is to be brought by the tenant.
  2. It is not permitted to sleep in the beds without any bedsheets. When using sleeping bags it is also required to put a bedsheet over the matrass and use a pillowcover.

12.Waste sorting

  1. Waste/garbage must be sorted as mentioned on the pictures shown above the garbage bins outside as well as on the refrigerator inside. If this is not done, the household waste will not be collected by the commune. As a result we will have to go through your waste, which is not a fun job.
  2. glass waste such as bottles and glasses, must be disposed in town at specific glass disposal container locations. The location of the nearest glass disposal container is mentioned in the information file.

13. End of your stay and Check-out/Departure

1.End of stay

  1. The rented holiday home must always be left neat and tidy after your stay. This implies:
  • Tidying up the house,
  • Everything needs to be put back in its original place,
  • empty trash bins,
  • tidy up the kitchen counter,
  • make sure all dishes are clean and put back in the cupboard.
  1. To sum it up in one sentence: the house must be left tidy and neat.
  2. The garden also needs to be left in a tidy condition as it was upon arrival.

2.Departure/Check- out

  1. The tenant closes and locks the windows and doors before departure (also the rooftop windows)
  2. Turn off all lights
  3. Set the heating to 10 degrees
